On October 30, 2006, Dura Automotive Systems, Inc., along with 41 of its affiliates (collectively, the “Debtors”), each filed a voluntary petition for relief under chapter 11 of the United States Bankruptcy Code (the “Bankruptcy Code”). The Debtors were each assigned separate case numbers (collectively, the “Bankruptcy Cases”) but are being jointly administered under Case No. 06-11202. The Bankruptcy Cases are pending before the Honorable Kevin J. Carey in the United States Bankruptcy Court for the District of Delaware.
The United States Trustee (the “UST”) has appointed a committee (the “Creditors' Committee”) to represent the general unsecured creditors in this matter. The UST’s selection of members is generally based upon the size of the members’ claims as listed by the Debtors on their petitions for relief and, occasionally, on the UST’s desire to appoint members from multiple constituencies (e.g. vendors, customers, landlords, etc.).
Pursuant to the Bankruptcy Code (specifically including, but not limited to, 11 U.S.C. § 362), a debtor is afforded certain protections against its creditors; the Bankruptcy Code prohibits creditors from taking certain actions related to debts that may have been owing prior to the commencement of the Bankruptcy Cases. If you believe that you might be a creditor of the Debtors based upon debts arising prior to October 30, 2006, and you are considering taking action based upon your status as a creditor, you may wish to seek legal advice.
